Awohah acts solely as an intermediary platform that enables connections. We do not own, sell, resell, provide, control, or manage any listings, products, or services offered by users or businesses on the Platform.

2. Acceptance of Terms

By using Awohah, you confirm that:

• You are at least 18 years old.
• You have read and understood these Terms.
• You agree to comply with all applicable laws and community standards.

We reserve the right to modify these Terms at any time. The updated version will be posted on our website with a new effective date. Continued use of the Platform after any update means you accept the revised Terms.

3. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information.

• Accept full responsibility for any activity under your account.

Awohah may suspend or delete accounts that violate these Terms, engage in fraud, or misuse the Platform.

Users are responsible for verifying the authenticity and reliability of any offer, listing, or seller before engaging in a transaction. Awohah does not intervene in private agreements or disputes between users, except as described in these Terms.

5. Transactions and Payments

When a user buys or sells through Awohah:

• The transaction is directly between the buyer and the seller.
• Awohah does not handle, control, or guarantee delivery, payment, or refunds.
• All payments are processed by independent third-party providers such as Stripe, PayPal, or Adyen.

Any issues related to payment authorization, chargebacks, or refunds must be resolved directly between the involved parties.

Awohah may, at its discretion, offer optional support or insurance programs for specific verified listings or services. Only when such programs are clearly stated and purchased by the user will Awohah assume limited responsibility under those conditions. Otherwise, all transactions are solely between users.

6. Authenticity, Fraud, and Scams

Users are solely responsible for confirming the legitimacy of any listing, offer, or transaction. Awohah strongly encourages:

• Reviewing the seller's profile and ratings.
• Communicating through the Awohah messaging system only.
• Avoiding advance payments or transfers outside the Platform.

If a user suspects fraud, impersonation, or a scam, they should:

• Immediately stop communication with the other party.
• Report the issue using Awohah's reporting system or contact info@awohah.com.
• Leave an honest review to warn other users.

Awohah reviews reports and may suspend or remove users or listings that violate our policies, but we do not guarantee refunds or recovery of losses. Awohah is not responsible for financial loss, damages, or outcomes arising from user-to-user transactions.

7. Optional Support and Protection Programs

Awohah may offer optional services such as 1-on-1 assistance, mediation, or verification for certain bookings or purchases, and transaction protection or insurance, clearly indicated on eligible listings. Only if a user has paid for or explicitly used these programs will Awohah's liability extend to the scope described in that specific program. Otherwise, all transactions remain strictly between the buyer and the seller.

8. Reviews and Ratings

Awohah allows users to post reviews and ratings to share experiences. By posting content, you grant Awohah a non-exclusive, worldwide, royalty-free license to display, distribute, and use that content for marketing and platform purposes.

Reviews must be honest, respectful, and relevant. Awohah reserves the right to moderate, edit, or remove content that violates community standards, contains false information, or incites harm.

9. Content and Intellectual Property

All intellectual property rights on the Platform, including design, code, and trademarks, belong to Awohah by Velotary Ventures. Users may not copy, modify, or redistribute content from the Platform without written permission.

User-generated content (such as photos, listings, or text) remains the property of the user, but by posting it, you grant Awohah the right to display and use it within the Platform and related promotions.

10. Prohibited Activities

You agree not to use Awohah for any activity that breaks the law, harms the community, or conflicts with the purpose of the Platform. This includes but is not limited to:

• Posting or selling illegal, counterfeit, or stolen items.
• Uploading or promoting adult, sexually explicit, or pornographic material. Awohah focuses on travel, local culture, business, and community connections, so adult or sexual content is not allowed on this platform even if legal elsewhere.
• Sharing violent, discriminatory, or hateful content.
• Using Awohah for harassment, spam, or deceptive behavior.
• Posting misleading listings or impersonating another person or business.
• Uploading material that violates copyright, privacy, or brand rights.
• Circumventing Awohah's payment or messaging systems.
• Using automation, bots, or scraping tools to collect data.
• Misusing the Awohah name, logo, or identity for unrelated purposes.

Awohah reserves the right to review or remove content and accounts that do not align with the purpose of the Platform or that risk the safety or reputation of the community. Violation of these rules may result in immediate account termination, removal of all listings, and reporting to authorities when applicable.

11. Liability Disclaimer

Awohah provides the Platform "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, reliability, or suitability of listings, users, or services.

To the fullest extent permitted by law, Awohah by Velotary Ventures, its employees, and partners shall not be liable for:

• Losses, damages, or disputes arising from transactions between users.
• Misrepresentation, fraud, or scams committed by users or businesses.
• Technical errors, downtime, or data loss.
• Third-party payment processing failures.
• User negligence, illegal activity, or violation of these Terms.

Awohah is not a guarantor of any transaction. Any risk from using the Platform lies solely with the users who choose to engage.

12. Disputes and Resolution

If a dispute arises between users, it must be resolved directly between them. Awohah may, at its discretion, assist in mediation or provide guidance, but we are not required to participate in disputes or enforce outcomes. Users may report misconduct through info@awohah.com, and Awohah may review, suspend, or ban accounts that violate these Terms.

13. Account Suspension and Termination

Awohah reserves the right to suspend or terminate any account that violates these Terms or applicable law, engages in fraud, spam, or abuse, shares or promotes pornographic, adult, or exploitative content, or poses a risk to the safety or integrity of the Platform. Termination may result in permanent deletion of your account and content without notice.

14. Privacy and Data

Your use of Awohah is also governed by our Privacy Policy. By using the Platform, you consent to our collection and handling of data as described in that policy.

15. Changes to the Platform

We may modify or discontinue any part of Awohah at any time without prior notice. We are not liable for any impact such changes may have on users or their businesses.

16. Indemnification

You agree to indemnify and hold harmless Awohah by Velotary Ventures, its affiliates, employees, and partners from any claims, damages, losses, or legal actions arising from your use of the Platform, content you post or share, transactions or interactions with other users, or violation of these Terms or applicable laws.

17. Business Listings and Public Information

Awohah includes listings created from publicly available information, such as official business registers, websites, social media pages, online directories, and other open sources. This approach allows travelers and locals to easily discover real businesses, venues, and experiences across the islands.

These public listings are automatically generated and displayed as basic business pages, similar to how search engines and directories display business information. They may contain general details such as business name and category, address or location, publicly visible contact information, opening hours, website, or social media links, and photos, descriptions, or media that are publicly accessible online.

If you are a business owner or authorized representative, you may claim your business listing to verify ownership and gain full control of your page. Request edits or corrections at any time, completely free of charge.

To claim your listing, you must complete Awohah's verification process. Once verified, you will be able to add the business to your personal or company profile, manage and update all business details, and post listings, services, or products for sale directly under your verified business page.

Unverified or unclaimed listings will remain as basic informational pages visible to the public. These unverified pages do not support posting products or using business tools until ownership is confirmed.

Awohah relies on publicly available information and strives to ensure all listings are accurate and respectful. We do not remove factual business listings simply upon request. Listings will only be removed or modified if the information is proven to be false, misleading, or defamatory, in violation of privacy laws or other legal obligations, or promoting illegal or unsafe activity.

The inclusion of a business listing on Awohah does not imply endorsement, partnership, or accuracy certification. By using the Platform, all users and businesses acknowledge that factual, publicly available business information may appear on Awohah and may be displayed for discovery purposes.

18. Verification, Claims, and Blacklist Policy

To maintain a trustworthy and transparent community, Awohah verifies ownership and authenticity of claimed business listings, accounts, and seller profiles. The verification process may include identity checks, proof of registration, documentation, or other forms of confirmation as determined by Awohah.

If verification cannot be completed or ownership cannot be confirmed, Awohah reserves the right to place the business or account on hold until verification is finalized, temporarily restrict access to commercial or promotional tools, or limit visibility or mark the account as unverified.

Verification is designed to enhance community safety but does not guarantee that a business or user is risk-free. Users engaging in transactions are still responsible for performing their own due diligence.

If a business or account receives repeated, unresolved complaints, verified fraud reports, or patterns of suspicious activity, Awohah may suspend or restrict the account or business page, mark the profile as "under review" or "restricted," or add the business or account to Awohah's Public Blacklist, visible to users on the Platform.

The Public Blacklist is designed solely to protect the Awohah community and inform users about potential risks. It may include businesses or users that have ignored repeated dispute resolutions or refund requests, engaged in verified or suspected scam behavior, or failed to comply with verification or identity checks.

By signing up for Awohah or claiming a business listing, all users agree to this verification and blacklist policy. Awohah reserves the right to list, restrict, suspend, or publicly identify accounts or businesses that repeatedly violate trust or fail verification requirements.

If you believe your account or business has been incorrectly blacklisted or restricted, you may contact info@awohah.com with proof and supporting documentation for review. Awohah will evaluate appeals at its sole discretion, and its decisions are final unless required otherwise by law.

Awohah is not responsible for reputational, financial, or commercial losses arising from account holds, verification processes, or blacklisting decisions made in good faith and in accordance with this policy.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Spain. Any dispute shall be resolved exclusively in the competent courts of the Spain.

Final Acknowledgment

By using Awohah, you confirm that you are at least 18 years old and have read, understood, and agreed to these Terms of Service. Your continued use of the Platform means you accept all responsibilities associated with your listings, communications, and transactions.
